Texas lawmakers initially issued a statewide ban on water softeners in 2001 before amending the law in 2003. Nowadays, water softeners are legal in Texas—under certain conditions. Texas’ Health and Safety Code states that homeowners and business owners can install or use water softeners that discharge water into an on-site sewage disposal only if:
- By design, the system conserves water
- The system regenerates using a demand-initiated regeneration (DIR) control device
- The system is clearly labeled as being equipped with a DIR device
The code also states that installations of point-of-use reverse osmosis systems are permitted, plus it allows for the use of point-of-entry reverse osmosis systems if the calculated volume of discharged water doesn’t cause hydraulic overloading or has been adequately addressed in the design of the on-site sewage disposal system.
